Terms of Service
Effective date: March 6, 2026
1. Agreement
By accessing or using ConeTime's website (conetime.com) and cloud timing platform (the "Service"), you agree to these terms. If you are using the Service on behalf of a club or organization, you represent that you have the authority to bind that organization to these terms.
2. The Service
ConeTime provides a cloud-based autocross timing platform that receives data from timing gate hardware, calculates results, and publishes them in real time. The Service includes event management, result calculation, photo matching, and club branding features.
3. Accounts
Club administrators are responsible for maintaining the security of their account credentials and for all activity under their account. You agree to notify us immediately at support@conetime.com if you become aware of any unauthorized use.
4. Your Data
You retain ownership of all data you enter into the Service (driver information, event configurations, class definitions). We do not claim ownership of your content. You grant us a limited license to store, process, and display your data solely to operate the Service on your behalf.
You are responsible for ensuring you have the right to upload any data (including driver names and photos) to the Service and for complying with applicable data protection laws in your jurisdiction.
5. Photos
Gate hardware captures photos at timing lines during events. These photos are stored in your club's isolated data partition, matched to runs, and displayed to users viewing event results. Photos are not shared with other clubs or used for any purpose beyond operating the Service for your club.
6. Acceptable Use
You agree not to:
- Use the Service for anything other than legitimate autocross or motorsport timing
- Attempt to access another club's data or circumvent tenant isolation
- Interfere with the Service's infrastructure or other users' access
- Reverse engineer, decompile, or otherwise attempt to extract the Service's source code (the cloud platform — the gate hardware firmware and designs are open source)
7. Hardware
Gate hardware purchased through the "Ready to Go" option is sold as-is. Hardware is yours to keep regardless of subscription status. Open-source hardware designs are provided under their respective open-source licenses without warranty. We are not responsible for hardware built from our open-source designs by third parties.
Ready to Go hardware may be returned within 60 days of delivery for a full refund, provided the hardware is in working condition.
8. Subscription and Payment
The Service is offered on an annual subscription basis. Pricing is communicated at the time of sign-up. The "Ready to Go" option includes 2 years of cloud service; after that period, it renews at the standard annual rate. Early adopter terms (including any free service periods) are specified in your individual agreement.
9. Service Availability
We strive to maintain high availability but do not guarantee 100% uptime. The Service depends on internet connectivity, AWS infrastructure, and proper hardware operation. Gate hardware includes offline fallback capability to ensure timing continues during connectivity interruptions.
10. Limitation of Liability
ConeTime is a timing tool, not a safety system. We are not liable for any decisions made based on timing data, event outcomes affected by timing accuracy, or any indirect, incidental, or consequential damages arising from use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
11. Termination
Either party may terminate the subscription at any time. Upon termination, your data is retained for 90 days to allow for re-activation or export, after which it may be permanently deleted. You may request immediate data export or deletion by contacting support.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated to active club administrators via email at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
13. Governing Law
These terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the state where ConeTime is incorporated.
